Concept of Conflict and Negotiation

Question: Discuss aboout the Concept of Conflict and Negotiation. Answer: Introduction: Conflict is a process that begins when an organization perceives that another organization has created negatively affect after the negotiation agreement. As stated by Ada (2014), transition is a process thought which the organization avoids the conflict. It has been observed that there are three types of conflicts such as low to moderate level, high level and low level. As stated by Prenzel and Vanclay (2014), negotiation is a process which occurs when two or more parties decide to allocate scarce resources. The two organizations have used distributive bargaining and integrative bargaining to negotiate with each other. Relevance of negotiation to Project Management: It has been observed that five publishers have implemented the negotiation plan with Apple in January 2010 (bbc.com 2016). According to the negotiation plan the publishers had sold their e-books through Apples new product, the iPad. According to Robbins et al. (2013), the publishers have paid 30% of the profits as sales commission. However, it has been observed that the publishers had implemented their own pricing strategy for those e-books in the 2012 (Levine et al. 2013). It was observed that the publishers had increased the price of the ebooks in iPad library, but they still sold their e-books at a wholesale price in online retail stores like Amazon. It has been noticed that Apple users had paid more than $14.99 for an e-book. On the other hand, the same e-book was available in Amazon for $9.99 (bbc.com 2016). In that situation the Department Of Justice (DOJ) lawsuit had suggested that the e-book publishers had neglected the negotiation contract. Similarly five e-book publishers h ad failed to maintain the US antitrust law (bbc.com 2016). As stated by Prenzel and Vanclay (2014), the e-book publishers had neglected the negotiation rules and the agreement between the e-book publishers and Apple. In this case the negotiation is not relevant because the e-book publishers had implemented the negotiation contract with Apple. According to the contract, the e-book publishers had paid 30% of their profit to Apple (Ada 2014). Therefore, the sales and promotional plan of iPad was depending on the popular e-books. The e-book publishers had sold their books at a low price in Amazon. This negotiation strategy had affected the e-book publishers. The e-book publishers had paid less amount of commission to Apple (Lumineau and Henderson 2012). On the other hand, the customers started refusing iPads due to the high price of the e-books. Therefore the e-book publishers and Apple needs to observe ethical and legal implications. As stated by Gardi et al. (2013), Apple had reported the entire concern to the United States Department of Justice (USDOJ) (bbc.com 2016). The USDOJ had taken legal actions against the publishers for increasing the price of the e-books. Post this incident, three publishers were settled down their ethical discrimination with Apple. The other two publishers wanted to reconstruct the negotiation strategy with Apple. (Levine et al. 2013). Therefore, this re-negotiation strategy implementation was of much relevance to Apple because the organization has already faced much lack of trust regarding the e-book sales. Settlement is a true dispute resolution process: It has been observed that two organizations implement the negotiation process for improving their market share, profit and brand value. The settlement process is accepted by two organizations with the help of dispute resolution process. It has been noticed that 65% settlements had been implemented by the organization through the adjudicative process (Robbins et al. 2013). According to Levine et al. (2013), in adjudicative process, the judge or arbiters determine the outcome of the settlement. As argued by Ada (2014), the adjudicative process is not always beneficial for the affected organizations under the negotiation contract. Sometimes the settlement between two organization has affected one organization inspire of benefits of that organization. According to Apple and the e-book publishers incident, it has been observed that Apple had implemented the beneficial agreement between two industries. Later it was seen that the e-book publishers sold their books through the Apple iPad as well as the online retail shops (Borrini et al. 2013). Moreover, the price difference between the Amazon website and Apple iPad has affected Apples business. The publishers have sold those e-books at lower prices in Amazon as compared to the iPad library. Therefore Apple had reported about this offence to the United States Department of Justice (USDOJ). As argued by Prenzel and Vanclay (2014), the settlement contract between Apple and the e-book publishers were confidential. Therefore, Amazon was unable to gather knowledge about the contract and regulate the e-book price in their online retail website. On the other hand, the consensual settlement process is better for the organization because this settlement process is regulated by the collaborative law, mediation, negotiation and conciliation. As stated by Robbins et al. (2013), the benefits of the settlement process would be maintained by those laws or acts so that the affected company may obtain justice. As argued by Levine et al. (2013), if an industry fails to maintain the negotiation contract, then in that case other industries may take the legal action against them. As stated by Borrini et al. (2013), the negotiation process is beneficial for both organizations. If the Apple and the e-book publishers had implemented the settlement under collaborative law, mediation, negotiation and conciliation regulation then the settlement is required to be formal. Therefore, Amazon should be aware about the negotiation contract and regulate the e-book price in their website (Helms et al. 2012). Therefore the consensual negotiation process could be better than adjudicative process for Apple. As argued by Gardi et al. (2013), Apple had taken legal actions against them and made the settlements with three publishers. It has been noticed that that the settlement was not beneficial from the negotiation contract. On the other hand, Apple had continued the negotiation contract with two publishers and this may not be suitable for the organization. Conclusion: The negotiation process would be beneficial for both the organizations. However, it is not happening all time. With respect to the contact between Apple and the e-book publishers, it is understood that the e-book publishers had implemented some unethical strategies to collect maximum profit from the business. In the light of this Apple had taken the legal action against the e-book publishers. Consequentially, three e-book publishers had implemented the confidential settlement with Apple. Other two organizations had implemented another negotiation strategy with Apple. Therefore Apple was not perfectly beneficial from the legal judgment. Apple needed to implement the consensual settlement process so the negotiation will be formal and no organization will be interested to implement the negotiation strategy with those e-book publishers in future. danimals Essay Example For Students

danimals Essay If you have never heard of Animal Psychology as a field in psychology, it may because there are other terms, Animal Behavior and Comparative Psychology, for example, being used to mean similar things. If you still have doubts, I recommend that you take a look at two journals published by the American Psychological Association (APA). Journal of Comparative Psychology publishes original empirical and theoretical research from a comparative perspective on the behavior, cognition, perception, and social relationships of diverse species. Journal of Experimental Psychology: Animal Behavior Processes publishes experimental and theoretical studies concerning all aspects of animal behavior processes. Studies of associative, nonassociative, cognitive, perceptual, and motivational processes are welcome. Another research journal indicating the place of basic psychological concepts in the field of animal behavior is Animal Learning and Behavior It publishes experimental and theoretical contributions and critical reviews that cover the broad categories of animal learning, cognition, motivation, emotion, and comparative animal behavior. Specific topics include classical and operant conditioning, discrete-trial instrumental learning, habituation, exploratory behavior, early experience, social and sexual behavior, imprinting, and territoriality. Considering the fact that, biologically speaking, humans are animals, it is only natural that psychology, the science that devotes itself to the study of the human mind and human behavior, also be involved in the study of non-human animals. However, the perspective of psychology is unique compared with that of the other disciplines involved in animal behavior studies. Psychologists study animal behavior to enhance our knowledge of human physiology and psychology. In fact, animal research has already enhanced our understanding of human learning and intelligence, stress, and behavior such as aggression and reproduction. Furthermore, psychologists are currently applying animal behavioral knowledge to enhancing the well-beings of humans in areas of Animal Assisted Therapy and Animal Assisted Activities. Behavioral psychologists, along with clinical psychologists and professionals from other areas of animal science have joint their efforts in areas of applied companion animal ethology, psychology and behavioral therapy. Like psychologists in other areas *aa010500a.htm*, animal psychologists who have obtained a Ph.D. usually engage in three types of work: teaching, research, and applied work. Although it is most likely for animal psychologists to find teaching positions in departments of psychology, biology, and zoology, there are also opportunities in departments of anthropology, sociology, entomology, animal and poultry science, wildlife biology, and ecology, or in medical or veterinary colleges. Research opportunities usually lie in universities, research institutions (both government and private), zoos, conservation groups, and museums. Research areas range from purely scientific to more applied. For animal psychologists interested in applied work, there are a variety of career fields for them: companion animal behavior consultancy, livestock production, managing wildlife populations, treating the behavioral problems of pets or other domestic animals. The Animal Behavior Society (ABA */gi/dynamic/offsite.htm?site=http://www.cisab.indiana. edu/ABS/index.html*) has certification programs for those working in the clinical animal behavior field (i.e., working with animals with behavioral problems). To become a Certified Applied Animal Behaviorist requires either a doctoral degree from an accredited college or university in a biological or behavioral science with an emphasis on animal behavior and five years of professional experience, or a doctorate in veterinary medicine from an accredited college or university plus two years in a university-approved residency in animal behavior. Certified Applied Animal Behaviorist can be viewd as the counter-title to Licensed Clinical Psychologist. Clinical animal behavioral specialists who has a Masters Degree but not a Ph.D. can also be certified by the ABA, as an Associate Applied Animal Behaviorist. They often find jobs as research assistants or educators in universities, zoos, museums, and government, and private facilities.

How was I so blind? Steven was there, always there. I was foolish, young, and full of the spirit of adventure. Not wanting to sit still, and certainly not wanting to listen to my parents, I let my young whims and desires run away with me, so to speak. I had my best friend nearby, sure, but he was there to lend a hand in picking up the pieces after I had been broken, or to fill in the dead air when no other plans were made. I was not yet cognizant of the unfairness with which he was treated, or that I had viewed him incorrectly the entire time. To me, love was a silly notion, something that was used as an excuse for people who had religion on their side to get in between the sheets without the fiery wrath of their god or their parents. But I understand and appreciated many of the Greek words for love, such that they presented delineation between the love we feel for family members, for friends, and for those with whom we are intimately involved. I appreciated this thought, as it offered an explanation for the different feelings I had for different people in my life, rather than lumping them all together under one title. Broken, yet again, and sitting alone, there was no second thought about who to call. There was only one person I could stand to see and that one person was the perfect mixture of support, structure, and mutual trust. I was able to rely upon the one person to make me laugh. He never had to ask if I was not feeling well, or if something was wrong. He always knew how to make me laugh. He would say the perfect thing no matter the situation. Suddenly I was quite sick. I was taken over by a serious infection, something the doctors couldn’t diagnose. Multiple hospital visits, countless needles and blood, and restless days spent in bed were only made better by the regular, unasked for visits by my best friend. Never was I only subjected to hospital pillows and food, for he brought me both. Soon enough, a feeling of appreciation developed. I was appreciative for his kind acts. His refusal to leave the bedside, and to always care for me thereafter turned into something stronger. He stood up for what he believed in one day, against all manner of harassment, not backing down from his religion or his love of books. Witnessing this turned my feelings of appreciation into respect. I respected him for his convictions. This level of respect, over the course of many years converted itself into adoration and liking him. I liked him, wanted to be near him, and never wanted to be apart. But with time, this feeling too converted i tself into love. But this love was much stronger than any other love felt before and was unique in its foundation. It had taken me years, multiple years of trials and tribulations before I realized that there were feelings there which were much more important and significant than what many people foolishly considered â€Å"love†. Searching for that one person to make everything right, searching for that one person who was there without even being asked.

Affirmative Action Term Paper Example | Topics and Well Written Essays - 2000 words

Affirmative Action - Term Paper Example The following will explore job discrimination with an eye to how this form of discrimination affects certain groups of people in the labor market and how society has attempted to protect these people from discrimination. Taking a controversial approach to minority set aside programs, this essay will then persuasively argue that since these programs promote discrimination themselves, they are inherently defeatist and promote the same type of behavior that they try to eradicate. We now begin with an overview of the reasons for minority set aside programs – also called â€Å"Affirmative Action† in the United States – and this will follow with a concise rebuttal of the needs for such programs. Discrimination in the workforce affects people from all walks of life. Accordingly, the employment opportunities of half of our population are hindered by latent and overt sexism in the offices of America. It is well known that women in America earn substantially less than their male counterparts. The Equal Pay Act (EPA) of 1963 was established more than four decades ago to protect men and women who perform the same tasks from wage-based discrimination. Sexism is an unfortunate aspect of our modern society but the EPA seeks to combat it through positive legislation aimed at correcting the pay discrepancy between men and women in the labor force. Older workers also face a variety of impediments to their active inclusion in the labor force and the Age Discrimination in Employment Act (ADEA) of 1967 protects individuals who are 40 years of age or older from discrimination at work. Finally, people with disabilities face a plethora of hurdles in society and the Americans with Disabilitie s Act (ADA) of 1990 was established to ensure the full inclusion of people with disabilities in American society. Covering a wide variety of instances of discrimination, the ADA is one of the most recent pieces of legislation mentioned above which aims to tackle problems
